3. Eligibility & Regional Restrictions

By using this website and placing an order, you confirm that:

       You are at least 18 years of age;

       You are a resident of the United States; and

       You are legally authorized to enter into these Terms of Service.

Our products are currently available for delivery to all 50 U.S. states only. We do not ship to P.O. Boxes or international addresses at this time.

 

4. Products & Descriptions

We strive to present our products accurately. However, we do not warrant that product descriptions, images, or other content are entirely error-free, complete, or current at all times. Colors, textures, and packaging may vary slightly due to monitor settings, product batches, or fulfillment partner updates.

All products are intended for cosmetic, external use only. Individual results may vary.

 

5. Orders, Pricing & Payment

Accuracy: You agree to provide current, accurate, and complete information when placing an order.

Pricing: All prices are listed in U.S. Dollars (USD) and are subject to change without prior notice. In the event of a pricing error, we will contact you before processing and you may proceed at the corrected price or cancel.

Payment Security: Payments are processed via secure third-party gateways (such as Stripe). Madevia does not store, access, or retain your full payment card details at any time.

Right to Refuse: We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, unauthorized reseller activity, or product unavailability.

 

6. Shipping & Delivery

Orders are fulfilled and shipped from within the United States by Supliful. Delivery is available to all 50 U.S. states.

Estimated Timeline: Delivery typically takes 3–7 business days. These are estimates only and are not guaranteed.

Risk of Loss: Title and risk of loss for all ordered items passes to you upon delivery to the carrier. Madevia is not liable for delays or losses caused by carrier issues, weather events, natural disasters, incorrect address entry, or any other circumstances beyond our reasonable control.

7. Returns, Refunds & Cancellations

Due to the personal care and hygiene nature of our products, all sales are final. We do not accept returns or exchanges on opened or used products under any circumstances.

However, we stand behind our products when an issue arises through no fault of the customer. A replacement or store credit will be considered — at our sole discretion — in the following situations:

       The product arrives damaged or defective;

       The wrong product or variant was shipped in error;

       The parcel is confirmed lost in transit by the carrier;

       An exceptional circumstance exists beyond the customer's control (force majeure).

To initiate a claim, contact support@madevia.com within 7 days of the confirmed delivery date (or expected delivery date for lost parcels), including:

       Your order number;

       A clear description of the issue; and

       Photographic or documentary evidence where applicable.

Each claim is reviewed individually. We reserve the right to request additional information. Cash refunds are only issued where required by applicable law.

 

8. Health & Safety

Madevia products are for external cosmetic use only and must not be ingested. We recommend performing a patch test before first use, especially if you have sensitive skin or known allergies.

Discontinue use immediately if irritation, rash, or any adverse reaction occurs. Consult a qualified healthcare professional if necessary. Nothing on this website constitutes medical advice.

 

9. Intellectual Property

All content on this website - including but not limited to text, images, logos, brand identity, and product descriptions - is the exclusive property of Madevia Ltd or its licensors. Unauthorized reproduction, distribution, or commercial use of any content without prior written consent from Madevia Ltd is strictly prohibited.

 

10. Limitation of Liability

To the fullest extent permitted by applicable law, Madevia Ltd and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from:

       Your use of, or inability to use, our website or products;

       Delays or failures in fulfillment by our third-party partner, Supliful;

       Errors, inaccuracies, or omissions in product content or descriptions; or

       Unauthorized access to or alteration of your data or transmissions.

Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product giving rise to that claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded under applicable law.

 

11. Dispute Resolution: Arbitration & Class Action Waiver

Please read this section carefully — it affects your legal rights regarding how disputes are resolved.

Informal Resolution: Before initiating any formal proceeding, you agree to contact us at support@madevia.com to attempt to resolve the dispute informally. We will make good-faith efforts to resolve the matter within 30 days.

Mandatory Arbitration: If informal resolution fails, you agree that any dispute, claim, or controversy arising from or relating to these Terms or your purchase shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Class Action Waiver: You agree to bring claims against Madevia only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Exceptions: Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Nothing in this section prevents you from filing a complaint with a relevant consumer protection authority.

 

12. Force Majeure

Madevia shall not be held liable for any failure or delay in performance of our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, strikes, government actions, carrier failures, or disruptions to our fulfillment partner's operations.

 

13. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. For U.S. consumers, applicable federal and state consumer protection laws of your state of residence remain enforceable where required by law.

Any dispute not subject to arbitration under Section 11 shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory local law requires otherwise.
